Terms of service

Please read these terms carefully before using our API or Dashboard.

Overview
If you intend to use this component with Finsweet's Table of Contents attributes follow these steps:
  1. Remove the current class from the content27_link item as Webflows native current state will automatically be applied.
  2. To add interactions which automatically expand and collapse sections in the table of contents select the content27_h-trigger element, add an element trigger and select Mouse click (tap)
  3. For the 1st click select the custom animation Content 27 table of contents [Expand] and for the 2nd click select the custom animation Content 27 table of contents [Collapse].
  4. In the Trigger Settings, deselect all checkboxes other than Desktop and above. This disables the interaction on tablet and below to prevent bugs when scrolling.

Acceptance

By accessing and using the Maxaa infrastructure, including our API, Dashboard, and related services, you agree to be bound by these terms. If you do not agree to all provisions herein, do not use our services. Your use of Maxaa constitutes acceptance of this agreement in its entirety.

Definitions

For purposes of this agreement, "Maxaa" refers to the operating layer for fiat and crypto payments provided by Maxaa and its affiliates. "Merchant" means any individual or entity that integrates with our API or uses our Dashboard. "Services" encompasses all payment processing, settlement, payout, and compliance infrastructure provided by Maxaa. "API" refers to our application programming interface through which merchants connect to our systems.

Account registration

Merchants must register for an account through our onboarding process. You agree to provide accurate, complete, and current information during registration. You are responsible for maintaining the confidentiality of your API keys and account credentials. Any activity under your account is your responsibility. Notify us immediately of unauthorized access or use.

Prohibited use

You agree not to use Maxaa for illegal activities, money laundering, sanctions evasion, or financing of prohibited activities. You will not attempt to reverse engineer, disassemble, or gain unauthorized access to our systems. You will not use our infrastructure to process payments for high-risk merchants, gambling operations, or other restricted categories without explicit written consent. You will not engage in fraud, misrepresentation, or deceptive practices. Violation of these prohibitions may result in immediate account termination and legal action.

Fees and payment terms

Maxaa charges fees for services as outlined in your merchant agreement. Fees are calculated based on transaction volume, settlement method, and currency pairs. You authorize Maxaa to deduct applicable fees from settlement proceeds. Fee changes will be communicated with thirty days notice. Continued use of our services after notice constitutes acceptance of new fees.

Liability and limitations

Maxaa provides the infrastructure on an as-is basis. We do not guarantee uninterrupted service or error-free operation. To the maximum extent permitted by law, Maxaa is not liable for indirect, incidental, consequential, or punitive damages arising from your use of our services. Our total liability for any claim shall not exceed the fees paid by you in the twelve months preceding the claim. Some jurisdictions do not allow limitation of liability, so this provision may not apply to you.

Indemnification

You agree to indemnify and hold harmless Maxaa, its officers, directors, and employees from any claims, damages, or costs arising from your use of our services, violation of these terms, or infringement of third-party rights. This includes reasonable attorney fees and court costs.

Changes to terms

Maxaa reserves the right to modify these terms at any time. Material changes will be communicated via email or through your Dashboard. Your continued use of our services following notice of changes constitutes acceptance. If you do not agree to modified terms, you must terminate your account.

Termination

Either party may terminate this agreement at any time with written notice. Maxaa may terminate immediately if you violate these terms or engage in prohibited activities. Upon termination, your access to our API and Dashboard will be revoked. Outstanding fees remain due. Sections regarding indemnification, liability, and governing law survive termination.

Data and privacy

Your use of Maxaa is subject to our Privacy Policy. We collect and process data necessary to provide our services and comply with regulatory requirements. You consent to this processing. We implement industry-standard security measures to protect your data. However, no system is completely secure, and we cannot guarantee absolute security.

Intellectual property

Maxaa retains all rights to its API, Dashboard, documentation, and related intellectual property. You may not copy, modify, or distribute our materials without permission. Your use of our services grants you a limited, non-exclusive license to access and use them for your business purposes only.

Regulatory compliance

Maxaa operates in compliance with applicable financial regulations and anti-money laundering laws. You agree to comply with all relevant laws in your jurisdiction. We may require additional information or documentation to verify your identity and business. Failure to provide requested information may result in account suspension or termination.

Dispute resolution

Any disputes arising from these terms or your use of Maxaa shall be resolved through binding arbitration in accordance with applicable law. You waive the right to pursue claims in court or participate in class actions. Arbitration shall be conducted by a single arbitrator mutually agreed upon by both parties.

Governing law

These terms are governed by and construed in accordance with applicable law. The exclusive jurisdiction for any legal proceedings shall be determined by the governing law applicable to your account.
